A. Off the top of my head, I think not. Child abandonment usually means something along the lines of leaving your child alone at the bus station. But you do have rights. See a lawyer or the Alabama Department of Human Resources and start getting your child's support out of this deadbeat dad.

A. I do not know the exact law in Michigan, however generally if a parent leaves a child with someone first question police will ask is if the parent has contacted the child/person in charge. Did the mother leave any financial assistance for the child, how long did the mother state she would be gone. Meaning, if parent says I'll be back in 6 hours and two days goes by, no call then the person should contact law enforcment. BUT... what could happen, is the police will come and declare the child in imm danger and place the child in foster care. I doubt that is what you want to happen to the child. Can't you/family talk to the mother and try to work something out where she allows the child to stay with another family member under a temp… [cont.]

A. He can only get her for child abandonment typically if she disappears and does not see or speak to or send ANY mail to her daughter for 2 years. At that time, he can file for full custody and if his ex decides to come back to try to be in her daughter's life after 2 years she will have no rights. However, for her rights to be legally stripped from her she must either sign over her parental rights or not see/contact/send anything to her daughter for the next 2 years. Either that, or he can go to court any time to sue for full custody. If she really is not around that often, he will most likely be granted full custody. Good luck.

A. No, you do not have to be the legal guardian; anyone who has present physical custody of the children can be charged with abondoment/child endangerment/child neglect. This could be a babysitter, relative, or friend who was supposed to be caring for the child. If the children are under your sister's care at the time, and she abandons them, she can be charged. She would have to actually leave them alone though; if someone else is there to watch them (your mother, you, a sitter, whoever), she's not abandoning them.

A. I live in Texas and if there is no communication with the father for 6 months you can have his rights terminated. However, you must have someone else who is willing to adopt the child. I know this because I am going though this with my 9 yr old son. Also, my attorney told me if he pays child support it is considereed communication. As of December 8th we will be able to terminate my ex's rights and my husband can adopt him. he hasn't seend my son since October 10, 2005 but he paid child support until June 8 of this year.

A. In order to sue a person, for any reason, there must be a equitable resolution available. What I mean is what punishment or award is hoping to get from his father, and is it something the court system has the power to enforce? If it is money, that should have been addressed under the issue of child support. If it is humiliation or public ridicule, that is not something for a court to handle.
